Modification to Terms and Conditions

We reserve the right to change these Terms and Conditions at any time, effective immediately upon posting on our Sites.

You may print a copy of these Terms and Conditions using the print feature in your browser. It is your responsibility to periodically visit the "Terms and Conditions" link at the bottom of our home page to review the most current version of the Terms and Conditions. You may use your browser to print copies of any updated Terms and Conditions.


Please note all credit cards are charged at the time of check out to help prevent fraudulent orders. Under no circumstances are you allowed to make a purchase with someone else'"s credit card, even with the card holder's consent. If you are a first time customer and making a purchase with a different shipping address, we reserve the right to require you to sign a purchase agreement to authorize the order.

All orders will be shipped via reputable couriers such as FedEx, UPS and USPS. We deliver anywhere in the US and we also deliver internationally (this excludes the Philippines).

Products Damaged or Shipped in Error

Products are free of damage and breakage when your order is shipped from our location. Although Phil Am Food products are packaged very carefully, damages may occur in transit. Please contact Phil Am Food if you should receive a damaged or broken product. Make sure to save all contents, including packaging, for FedEx or UPS to investigate. Phil Am Food will then submit a claim to the carrier for their investigation. The investigation may take up to two business weeks to complete. Replacement items will not be shipped until the claim process has been resolved.

Shipping charges on the original order will be refunded or a credit given only if the merchandise is damaged in transit or was shipped in error.


We will deliver to the shipping address that you specify. However, additional charges may apply if the package is redirected, an address is incomplete (except for zip code) or the wrong shipping sector was entered at the time of order. We are not responsible for shipping charges for packages returned due to missing or wrong information, with the exception of zip codes which we offer to provide on your behalf.

We try our utmost best to describe everything as much and as well as possible. All images of the products may slightly differ from actual products depending on current importing source.


We will accept returns as long as the merchandise is in sellable condition and is in the original manufacturer packaging. We guarantee freshness so if you're unsatisfied please email us within 3 days after receiving the merchandising via email to customersupport@philamfood.com with original packaging and invoice. Please return your purchase 10 business days for credit, refund, or exchange. All return shipping costs will be paid by the buyer or the recipient. If a customer receives the wrong merchandise (our mistake), we will ship you the correct item at no extra cost after receiving the wrong merchandise back or we would issue a refund check if the product is unavailable. The wrong merchandise can be returned to us at our cost. Always contact customer service to get a Return Authorization and clarify the process PRIOR to returning any item of merchandise. Shipping Policy

Orders can be placed 24 hours a day, 7 days a week. Orders received by 3pm Eastern Time will be processed the same day and will be packed and shipped within 1-2 days. In specific circumstances, if your order does not ship by the next two business days, Customer Service will notify you via email and/or phone explaining the delay.

Domestic Orders

Shipping is calculated based on the order weight and distance from our Jersey City, New Jersey location. You may choose FedEx, UPS or USPS for as your shipping carrier. FedEx and UPS Ground services can take up to 7 business days to arrive after the ship date. When shipping with FedEx, UPS or USPS an order confirmation will be emailed to you, which includes your tracking number. You may use the tracking number to check your orders progress at www.FedEx.com, www.Ups.com or www.USPS.com.

*shipping rates apply to orders up to 30 lbs frozen handling fee and shipping cost do not count toward order value when calculating if one qualifies for flat rate shipping

*Orders to PO Boxes must use FedEx Smart Post or USPS as the shipping method or additional charges will be applied

*Orders with frozen items that are shipped with more than a 2 day travel time are not recommended and we can not be held responsible for any damage to the items because of transit time

Phil Am Food is not responsible for incorrect information provided to us. A minimum $15 Change of Address fee will be charged if you change your shipping destination after your package is in transit. If your package has already been delivered, there will be additional charges for package pick-up and redelivery. IMPORTANT: FedEx and UPS does not ship to PO Box addresses.


If you wish to change your order after it has been placed, please send us an email immediately. If your order has already been processed, unfortunately, you will not be able to change it. Please understand that we try to provide the fastest turn-around time.

If you wish to cancel an order that has not been processed yet, please send us an email immediately and we will refund you 100% of what was charged to your credit card. If you wish to cancel an order that has been processed, we will refund you with 50% of total cost. If you wish to cancel an order that has already been shipped, no refund will be paid.

Terms of Acceptance of Goods

All items purchased from us are made pursuant to a shipment contract; this means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

Upon delivery, recipient shall inspect the items received and immediately inform us if the items received are not in good condition. If we have not been notified of any defect or error with the items received by 5:00 p.m. EST on the third (3rd) after delivery of the items, recipient shall be presumed to have accepted the items and shall have waived any rights there to. In case of charge backs or a refund by the buyer, recipient agrees to return the items received in their original state and packaging to us. In the event that this cannot be done, recipient will pay for the damage merchandise in full. Recipient will pay in US dollars unless otherwise specified on the delivery receipt. A penalty of 10% per month will apply on unpaid/unreturned merchandise and overdue accounts, plus all costs of collection, including but not limited to reasonable attorneys' fees. No return may be made, and no refund shall be given for perishable items. A 25% restocking fee will apply for all returned items.

APO/FPO Orders

Orders shipped to APO/FPO addresses can only be shipped via USPS priority. The package cannot be tracked after it enters the Military Mail System. Therefore, we are unable to determine the order delivery time. All orders shipped to APO/FPO addresses may take up to 60 days.

Note: APO/FPO addresses do not qualify for the shipping promotion offered by Philamfood.com. Extra shipping charges will be applied to your credit card automatically if other shipping carrier (FedEx and UPS) are chosen other than USPS.

PayPal Orders

Orders paid with PayPal will not be shipped until the funds have been transferred to Phil Am Food's account. All refunds will be returned to your PayPal account. Shipping address information must be updated through PayPal. If you use PayPal at checkout, the address listed with PayPal is the destination for your order. Phil Am Food cannot be responsible for incorrect information provided to us.

Address Correction

A $15 change of address fee will be applied if you change your shipping destination when your package is in transit. If your package has already been delivered, there will be additional charges for pick-up and redelivery.

Frozen Foods

Frozen Foods are available for shipping. The Cold Pack (dry ice) used to refrigerate the product has a life of 72 hours (3 days) which allows products to be shipped.

It is highly recommended that orders with frozen items that are being shipped to the West coast or Midwest parts of the United States are shipped using 2 day air to insure the freshness of the products for their arrival. Phil Am Food will not be responsible for any orders that are damaged or thawed out, if the areas mentioned above have chosen to use ground shipping as their shipping method.

When placing an order, you may select both frozen foods and non-frozen items for your shopping cart. You do not need to place separate orders for frozen food and other items.

When orders contain frozen items. There will be a frozen handling fee of $9.99 charged onto the order total.

Phil Am food only recommends shipping frozen products to customers residing in the continental United States. If frozen food is shipped to an APO or FPO address Phil Am Food is not responsible for the freshness of the product. FedEx and UPS are only the carriers Phil Am Food has selected to ship Frozen Food items.

Note: Because we deliver frozen food, we will not ship your order on days when there may be a risk that it could get held up in a distribution center over the weekend. Delivery times may vary depending on your UPS shipping area.

Discount Promotion

Discount promotion must be entered before placing your order. Phil-Am Food is not responsible if you forgot to enter your promotion code during check out. If you ever experience technical difficulties entering your discount code please call us immediately at 201-963-0455.

In Store Pick Up Orders

Please be advised that the frozen handling fee of $8.99 will be returned your credit card or PayPal account if you've chosen in store pick up. For credit card users please bring the credit card that you've use so we can return the frozen handling fee of $8.99 back to your card. (The frozen handling fee only applies to orders that contain frozen products.)

Note: If you've chosen in store pick up by mistake please email or call us immediately at 201-963-0455 the same day you place your order (before 7:00 pm EST times).

Gift Cards

Gift cards can be purchased for shopping on our site and only redeemed at www.philamfood.com. If a gift card is to be refunded we can only refund the amount of gift card that is not used but it must be in a 30 day period from day of purchase of product for us to be able to issue a refund
